Terms of Service

Welcome to UsTwo. These Terms of Service ("Terms") govern your use of the UsTwo mobile application and related services (collectively, the "Service") operated by UsTwo ("we," "us," or "our").

By accessing or using our Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service.

1. Acceptance of Terms

By creating an account or using the Service, you confirm that you are at least 13 years of age and have the legal capacity to enter into these Terms. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Description of Service

UsTwo is a mobile application designed to help couples maintain and strengthen their connections through:

• Sending custom notes with text, doodles, and photos
• Real-time collaborative drawing on a shared canvas
• Tracking daily interaction streaks
• Partner pairing via invite codes

3. UsTwo Pro Subscription

UsTwo offers an optional premium subscription called "UsTwo Pro" that provides access to additional features, including but not limited to:

• Additional drawing colors
• Photo attachments in notes
• Dark mode theme
• Other premium features as they become available

Billing and Payment

UsTwo Pro subscriptions are billed through the Apple App Store or Google Play Store, depending on your device. All payments are processed by Apple or Google, and their respective terms and conditions apply to your purchase.

Auto-Renewal

Your subscription will automatically renew at the end of each billing period unless you cancel it at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours prior to the end of the current period.

Cancellation

You may cancel your subscription at any time through your Apple App Store or Google Play Store account settings. Cancellation will take effect at the end of your current billing period, and you will retain access to Pro features until that time.

Refunds

Refunds are handled by Apple or Google in accordance with their respective refund policies. UsTwo does not directly process refunds for subscription purchases.

Price Changes

We may change subscription prices from time to time. Any price changes will be communicated in advance through the app or via email, and will apply to your next billing cycle after the change takes effect.

Partner Sharing

When you subscribe to UsTwo Pro, your paired partner may also receive access to certain Pro features while paired with you. This shared access is provided as a benefit of your subscription and may be modified at our discretion.

Free Tier

UsTwo remains available as a free service with core features. You are not required to subscribe to UsTwo Pro to use the basic functionality of the app.

4. User Accounts

To use certain features of the Service, you must create an account. You agree to:

• Provide accurate and complete registration information
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized access to your account
• Accept responsibility for all activities that occur under your account

5. User Conduct

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Harass, abuse, or harm another person
• Upload or share content that is illegal, harmful, threatening, abusive, defamatory, or otherwise objectionable
• Impersonate any person or entity
• Interfere with or disrupt the Service or servers
• Attempt to gain unauthorized access to any part of the Service
• Use the Service for any commercial purposes without our consent

6. User Content

You retain ownership of any content you create or upload to the Service ("User Content"). By submitting User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, store, and display your User Content solely for the purpose of providing the Service.

You are solely responsible for your User Content and represent that you have all necessary rights to share it. We reserve the right to remove any User Content that violates these Terms.

7. Intellectual Property

The Service and its original content (excluding User Content), features, and functionality are owned by UsTwo and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our prior written consent.

8. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, USTWO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

11. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease.

You may delete your account at any time through the app settings.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes by posting the updated Terms on this page and updating the "Effective Date." Your continued use of the Service after such changes constitutes acceptance of the new Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
